Terms and Conditions for SAJASOFT LLC

1. Acceptance of Terms

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. If you access the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms. If you do not agree to these Terms, you may not use the Services.

2. Services Provided

SAJASOFT LLC offers professional digital solutions including:

• Automation workflows, software templates, and integrations;
• Online courses, private video tutorials, and educational materials;
• Implementation, consulting, and installation assistance for digital tools.

The scope, deliverables, and pricing for each Service are detailed at the point of purchase or in the applicable statement of work.

3. Accounts and Access

You agree to provide accurate, current, and complete information when purchasing or accessing the Services and to keep that information updated. You are responsible for maintaining the security of your login credentials and any systems to which you grant us access. Notify us immediately if you suspect any unauthorized use of your account or credentials.

4. Payments and Billing

Fees are due at checkout unless stated otherwise in a signed agreement. We may use third-party payment processors, such as Stripe, to collect payments. By submitting a payment method you represent that you are authorized to use it and you agree to pay all charges incurred. All fees are quoted in U.S. dollars unless indicated differently.

5. Refund Policy

Our products include digital content (automation workflows, private video tutorials) and, if selected, optional installation or setup assistance.

• Once access to the digital materials has been provided, the purchase becomes non-refundable.
• If installation assistance is included, refunds are not available after the setup process has started or after you have shared access credentials (for example, an n8n instance, server, or API keys).
• Refunds are only available before access or setup work begins, or if access cannot be delivered due to technical reasons.

If you experience technical issues preventing access, contact us within seven (7) days of purchase. We will assist you or issue a refund if delivery was not completed.

6. License to Use

When you purchase digital content from SAJASOFT LLC, you receive a personal, non-exclusive, non-transferable license to use the deliverables for your internal business or personal purposes. You may not resell, sublicense, distribute, or make the content publicly available without our prior written consent.

7. Intellectual Property

All content, trademarks, service marks, logos, designs, code, and documentation made available through the Services are owned by or licensed to SAJASOFT LLC and are protected by intellectual property laws. You may not remove proprietary notices or use our branding in a manner that implies endorsement without permission.

8. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or tamper with the Services;
• Use the Services for unlawful, fraudulent, infringing, or harmful purposes;
• Share, publish, or upload malicious code, or interfere with the operation or security of the Services;
• Misrepresent your affiliation with SAJASOFT LLC or any third party.

9. Data and Privacy

We collect and use personal data as described in our Privacy Policy. By using the Services, you acknowledge that your information will be handled as outlined there.

10. Third-Party Services and Links

Some Services rely on third-party platforms or APIs. Those services are subject to the terms and privacy policies of the respective providers. SAJASOFT LLC is not responsible for third-party content or outages.

11. Disclaimer of Warranties

To the maximum extent permitted by Florida law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by Florida law, SAJASOFT LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the amounts you paid for the Service giving rise to the claim in the twelve (12) months preceding the event.

13. Indemnification

You agree to indemnify, defend, and hold harmless SAJASOFT LLC and its members, employees, contractors, and licensors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or violation of these Terms or applicable law.

14. Consumer Rights

Nothing in these Terms is intended to limit any non-waivable rights or remedies you may have under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) or other applicable consumer protection laws.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

16. Jurisdiction and Venue

You agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state and federal courts located in Saint Johns County, Florida, and you consent to the personal jurisdiction of such courts.

17. Arbitration Agreement

Except for claims that qualify for small-claims court, any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Saint Johns County, Florida, or by remote proceedings where permitted. The Federal Arbitration Act governs the interpretation and enforcement of this provision. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights or confidential information.

18. Class Action and Jury Trial Waiver

You agree that disputes will be resolved only on an individual basis and you waive any right to participate in a class, consolidated, or representative action. To the extent permitted by law, you also waive any right to a jury trial in any action or proceeding arising out of these Terms or the Services.

19. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on the Site and update the Effective Date. Material changes will be communicated through the Site or by email when feasible. Continued use of the Services after the changes become effective constitutes acceptance of the revised Terms.
